What every sender in Kenya should know
- The Kenya Information and Communications (Consumer Protection) Regulations, 2010 require automated direct-marketing schemes to be opt-in and to give a working way to stop messages.
- The Data Protection (General) Regulations, 2021 treat electronic messages as direct marketing: offer a free, simple opt-out in every promotional SMS and honour objections. The ODPC has made awards against firms over unsolicited messages.
- Safaricom separates promotional and transactional sender IDs. Its operator notice requires promotional traffic to carry an opt-out and to be sent between 08:00 and 18:00; OTPs and alerts are not time-restricted.
- Political bulk SMS follows the CA guidelines on political messages (vetting before sending, English or Kiswahili only).
Sender IDs in Kenya
- Sender IDs are registered per network (Safaricom, Airtel, Telkom) through a licensed provider, with a letter of authorisation, business registration certificate and sample message.
- On Safaricom one sender ID cannot carry both promotional and transactional traffic, so most brands register two.
- Network setup fees are one-off and listed on the Kenya sender ID page.

SMS in Kenya: common questions
What is the difference between promotional and transactional SMS in Kenya?
Transactional SMS (OTPs, receipts, account alerts) go on a transactional sender ID and can be sent at any time. Promotional SMS (offers, newsletters) need a separate promotional sender ID on Safaricom, an opt-out, and are sent between 08:00 and 18:00.
Does the Data Protection Act apply to SMS marketing?
Yes. The Data Protection Act, 2019 and its 2021 General Regulations cover direct marketing by electronic message. Use opted-in contacts, include a simple opt-out and stop messaging anyone who objects. Some sectors must also register with the ODPC.
